“User” means the individual or entity using the Service.
“User Content” means all photos, videos, captions, hashtags, or materials uploaded or
generated through the Service.
“Connected Accounts” means any social media accounts linked to the Service.
“AI Outputs” means captions, hashtags, or other generated text created using our AI
features.
You are solely responsible for:
Providing accurate account information and keeping it up to date.
Maintaining the confidentiality of your login credentials.
All actions taken under your account, whether authorized or not.
We grant you a limited, non-exclusive, revocable license to use the Service for
lawful purposes. You may not reverse engineer, copy, or create derivative works of
the Service.
You retain ownership of User Content but grant ServicePost a worldwide, royalty-free,
sublicensable license to store, process, display, and transmit it to operate the
Service. You are solely responsible for ensuring you have the rights to your content
and for backing up your data.
AI Outputs are for convenience only. You must review before posting. We disclaim all
liability for inaccuracies, infringement, offensive material, or reputational harm
caused by any service Outputs.
We rely on third-party APIs. These may change, limit, or stop functioning without
notice. We are not liable for posting failures, delays, or business losses caused by
third-party changes or outages.
You must not:
Violate any laws or third-party rights.
Post illegal, harmful, infringing, or defamatory content.
Misuse the Service to spread spam, malware, or harmful code.
All fees are charged in United States Dollars (USD), regardless of your location or
the currency of your payment method.
Subscriptions renew automatically unless cancelled before the renewal date.
You authorize us (or our payment processor) to charge your payment method for
recurring subscription fees in USD.
Payments are non-refundable, except where required by applicable law.
If payment fails, we may suspend access until payment is resolved.
We do not guarantee continuous or error-free operation. We are
not liable for interruptions caused by events beyond our control, including but not limited
to:
Internet outages
API changes
Acts of God, natural disasters, war, strikes, government actions, or pandemics
The Service is provided “as-is” without warranties of any kind.
You use the Service entirely at your own risk. You agree not to rely on the Service as your
sole method of content posting, marketing, or compliance.
To the fullest extent permitted by law:
Our total liability to you is limited to the total fees you paid to us in USD in the
12 months before the claim.
We are not liable for indirect, incidental, special, punitive, or consequential
damages, including loss of profits, data, goodwill, or business opportunities.
You agree to indemnify and hold harmless ServicePost, its
owners, officers, employees, and contractors from any claims, damages, losses, or expenses
(including legal fees) arising out of:
Your use of the Service
Your User Content
Your violation of these Terms or applicable law
Any disputes between you and third parties
Any dispute shall be resolved through binding arbitration in
Ontario, Canada, under the rules of the ADR Institute of Canada. You waive the right to
participate in a class action, class arbitration, or jury trial. All claims must be brought
individually.
You are responsible for ensuring your use of the Service
complies with:

We are not liable for indirect, incidental, special, punitive, or consequential
damages, including loss of profits, data, goodwill, or business opportunities.
US Federal Laws (including COPPA and CAN-SPAM)
Local privacy and data protection laws in your jurisdiction
We may suspend or terminate your account for any reason,
including violations of these Terms. Termination does not relieve you of obligations accrued
prior to termination.
If any provision of these Terms is found invalid, the rest
remain in effect. Provisions relating to liability, indemnity, and dispute resolution
survive termination.
We may update these Terms at any time. Changes are effective
upon posting. Continued use means acceptance.
These Terms are governed by the laws of Ontario, Canada, without
regard to conflicts of law. Where required by consumer law, local laws apply.
